The Sites offer the Kedemos Education catalog and the online store. They also provide exclusive content, interactive activities, and multimedia animations.

The present document constitutes the general terms and conditions of use (hereinafter the “GTC”) of the https://kedemoseducation.comhttps://kedemosonline.comhttps://platform.kedemoseducation.com, and https://ebooks.kedemoseducation.com websites.

Kedemos Education reserves the right to modify and update these GTC at any time and without prior approval from the User. The changes made will come into effect on the day they are posted online. Users are therefore invited to consult them regularly.

Consulting the Sites by any minor is placed under the exclusive responsibility of his legal representatives and their prior authorization.

Article 1: Account creation

The Sites allow the User to create a Member Account via the “Register” tab. Any registration by a minor under 18 must be authorized by his legal representatives.

Kedemos Education reserves the right to refuse any registration that does not comply with the Terms and Conditions of Use, and/or to delete the Account of any Member who does not comply with the GTC. 

Article 2: Services offered by the Sites

The Sites offer Users the Kedemos Education catalog, as well as information for professionals in education, parents, and children, under the conditions outlined in the present General Terms and Conditions and, if applicable, in the Terms of Sales for paying customers.

The Sites also allow professionals in education to benefit from online educational resources. These online educational resources allow the transfer of digital files and interactive activities on an electronic reading device connected to the Internet. This content is only intended for classroom use and at home for teaching purposes.

Kedemos Education grants its Customers a license/subscription, which is a non-exclusive and non-transferable right to use the content under the conditions defined in these general terms of use. This license is assigned to a User for a specific period of time which ends by the end of the school year.

A login username and a password are required to access the Digital Contents. The Access Codes provided by Kedemos Education to the Customer are confidential. The Customer is thus responsible for them. Any loss, theft, misappropriation, or unauthorized use of the Access Codes and their consequences are the sole responsibility of the Customer. The Customer is bound to not disclose the Access Codes in any form whatsoever to any third party. In the event of loss, theft, or accidental disclosure of the Access Codes, the User must inform Kedemos Education as soon as possible. Kedemos Education will cancel the Access Codes concerned and provide new ones.

The Customer commits to respect and to ensure that Users respect the mandatory provisions related to intellectual property and in particular the following rules:

  • Not to rent, sell, distribute, modify, or adapt in any form whatsoever, by any means, all or part of the Products.
  • Not to create databases based on the Products.
  • Not to distribute the Products in whole or in part on social networks, blogs, contributory websites, etc.

It is the Customer’s responsibility to contact Kedemos Education or its representatives to acquire access to the digital books. Kedemos Education cannot be held responsible for service interruptions due to the characteristics and limitations of the Internet network, technical performance, and response times for consulting the Products, mainly due to the presence of antivirus software and firewalls. Kedemos Education does not guarantee the Customer or Users against the risks, notably of hacking, from their computer equipment. It is the responsibility of Users and Customers to take all appropriate measures to protect their data and equipment.

Article 3: Intellectual property

The Sites are protected works. The trademarks, slogans, graphics, photographs, animations, videos, databases, and texts contained on the Sites are the exclusive property of Kedemos Education. They may not be reproduced, used, or represented under penalty of legal action.

The same applies to the underlying computer developments, technologies, and advancements that constitute the Sites. They may not be reproduced, decompiled, or disassembled without the express prior authorization of Kedemos Education, under penalty of legal action.

Kedemos Education grants the User the right to use the Sites for strictly personal, private, non-professional, and non-profit purposes only.

Any reproduction, in whole or in part, of the content of the Sites, by any means whatsoever, is prohibited and constitutes an infringement punishable under the Intellectual Property Law. The User undertakes not to use any content of the Sites outside the framework of the present document.

Article 4: Obligations and Responsibilities of the Users

Within the context of the Sites use, each User agrees to comply with the provisions of these GTC and any other charter or policy in force on the Sites and relevant to:

  • Use the Sites pursuant to the purposes set forth in these GTC.
  • Use the Sites for strictly personal purposes. The Member shall not use the Sites for commercial purposes or for sending unsolicited advertising or promotional material.
  • Not to violate or attempt to violate the security or integrity of the Sites.
  • Not to commit or attempt to commit any act of infringement by any means whatsoever.

The User guarantees the accuracy of the information transmitted to Kedemos Education.

The User is informed that any violation of these provisions may result in legal proceedings and sanctions against him.

Article 5: Technical obligations and constraints

The proper functioning of the Sites requires certain technical prerequisites. Due to the constant technical evolution of the Internet network, these requirements are always subject to change.

Kedemos Education assumes no responsibility for any interruption resulting from the normal limits of the Internet and the consequences that may arise from them.

In general, the User is prohibited from taking any action that may hinder or disrupt the proper functioning or accessibility of the Sites, mainly those relevant to its configuration or the functioning state of equipment.

The cost of accessing and browsing the Sites is the sole responsibility of the User.

Article 6: Obligations and Responsibilities of Kedemos Education

Kedemos Education’s general obligation in providing the Services is an obligation of means, and Users acknowledge that Kedemos Education has no obligation of result or reinforced means of any kind.

The Sites are accessible 24/7. However, the continuity and accessibility of the services available on the Sites are not guaranteed. Kedemos Education reserves the right to suspend, interrupt or limit, without prior notice, any access to all or part of the Sites for maintenance and upgrading operations necessary for the proper functioning of the Sites and related materials, or for any other reason, without the User having any possible recourse against Kedemos EducationKedemos Education will not be held liable for any damages of any kind that may result from these changes and/or the unavailability of the Sites.

Kedemos Education does not guarantee that the Sites and the server that provides their availability are free of viruses and other dangerous components. It is the User’s responsibility to take all appropriate measures to protect his own data and/or software from contamination by any viruses circulating on the Internet.

The User is informed that Kedemos Education may terminate or modify the characteristics of the Services offered on the Sites at any time, without prior notice.

Kedemos Education strives to ensure the quality of the Sites’ contents. However, Kedemos Education cannot guarantee the accuracy, timeliness, completeness, or updating of the information and documents appearing on the Sites and cannot be held responsible for any errors or omissions.

Kedemos Education declines all responsibility in the event of:

  • A virus attack leading to an intrusion into its information systems or data theft.
  • Abnormal use or illicit exploitation of the Sites.
  • User’s failure to comply with the contractual documents, and in particular with these GTCs.
  • Consequential failure, tangible and/or intangible, direct and/or indirect damage that could result from access to or use of the Sites, including inaccessibility, data loss, deterioration, destruction, or viruses that could affect the User’s computer equipment, and/or the presence of viruses on its Sites.

Article 7: General provisions

Not requiring the application of any clause of these GTCs, permanently or temporarily, can in no case be considered a waiver of said clause. If one of the stipulations of the present GTC were to be declared null and void, it will be deemed unwritten but will not affect the validity of the other clauses which will remain fully applicable.

Article 8: Personal data

Personal information related to buyers may be subject to automated processing. Kedemos Education reserves the right to collect information on buyers, including by using cookies.

Users may object to the disclosure of their personal information by notifying Kedemos Education. Similarly, users have the right to access and rectify their personal data.
